Terms of Service of the ENDORFY Online Store

About these Terms

These Terms of Service define the rules for using the ENDORFY online store available at www.endorfy.com and the rules for concluding and performing sales contracts for products offered through it.

These Terms apply to all persons using the Store, in particular Customers making purchases as consumers, entrepreneurs, and entrepreneurs exercising consumer rights in cases provided for by applicable law.

In matters not regulated by the above documents, the provisions of these Terms of Service shall apply.

Seller

The ENDORFY online store is operated by:

COOLING B2C spółka z ograniczoną odpowiedzialnością with its registered office in Sokołów (05-806), ul. Sokołowska 24, entered into the register of entrepreneurs of the National Court Register under number KRS 0001206753, holding NIP 5342704020 and REGON 543298878, hereinafter referred to as the Seller.

The language of sales contracts is the language selected by the Customer from those available in the Store.

Definitions

For the purposes of these Terms, the following terms mean:

  • Store – the ENDORFY online store operated by the Seller at www.endorfy.com.
  • Seller – COOLING B2C spółka z ograniczoną odpowiedzialnością with its registered office in Sokołów.
  • Customer – a natural person, legal person or organizational unit without legal personality using the Store or concluding a Sales Contract with the Seller.
  • Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity.
  • Entrepreneur with Consumer Rights – a natural person conducting business activity who is entitled to consumer rights under applicable law.
  • Product – a movable item offered for sale through the Store.
  • Customer Account – an individual account created in the Store, enabling the use of additional features.
  • Sales Contract – a contract for the sale of a Product concluded between the Customer and the Seller through the Store.
  • Business Day – a day from Monday to Friday, excluding public holidays in Poland.

Using the Store

Use of the Store is free of charge. Fees may arise only from concluding a Sales Contract or using services that are described as paid.

To use the Store properly, the following are required:

  • a device with Internet access,
  • an up-to-date web browser supporting cookies and JavaScript,
  • an active email address when using features that require electronic communication.

The Seller takes due care to ensure the Store operates continuously and securely, but temporary interruptions may occur due to technical work, maintenance or system updates.

The Customer is obliged to use the Store in accordance with its intended purpose, applicable law, good customs and these Terms. In particular, the following are prohibited:

  • providing unlawful content,
  • taking actions that may disrupt the functioning of the Store,
  • gaining unauthorized access to the Seller's IT systems,
  • using the Store in a way that infringes the rights of third parties.

Customer Account

The Customer may make purchases after logging into the Customer Account or without creating an Account (as a Guest). Creating and maintaining a Customer Account is free of charge.

The Customer Account enables in particular:

  • viewing order history,
  • saving data for future purchases,
  • managing delivery addresses,
  • managing marketing consents,
  • using features made available by the Seller.

The Customer is obliged to provide accurate data and to update it if it changes. The Customer may delete their Customer Account at any time using the relevant function in the Account or by contacting the Seller.

The Seller may temporarily restrict access to the Account or block it only for important reasons, in particular in the event of a breach of the Terms, use of the Store contrary to applicable law, or actions threatening the security of the Store or other users. Where possible, the Seller will inform the Customer of the reason for the restriction and allow the Customer to remedy the breach before deciding to permanently block the Account.

Products

The Seller sells ENDORFY brand products through the Store.

Information about Products presented in the Store, in particular their descriptions, photos, technical parameters, properties, compatibility and prices, constitute an invitation to conclude a contract within the meaning of the Civil Code and do not constitute an offer within the meaning of the law.

The Seller takes due care to ensure that the information presented in the Store is complete, up to date and accurate. Product photos are for illustrative purposes only. Due to device settings, color display or other technical factors, the actual appearance of the Product may differ slightly from that shown on the website. Such differences do not affect the conformity of the Product with the Sales Contract.

Products are available while stocks last.

Placing orders

Orders can be placed 24 hours a day, seven days a week, through the Store. To place an order:

  1. select the Product and its variants (if applicable),
  2. add the Product to the cart,
  3. proceed to the order form,
  4. provide the required details and select the delivery method and payment method,
  5. read and accept the Terms of Service,
  6. confirm the order by clicking the "Buy and pay" button or another equivalent formulation clearly indicating the obligation to pay.

Before placing the order, the Customer may review and correct all entered data. Placing an order entails an obligation to pay.

Conclusion of the Sales Contract

Upon receipt of the order, the Seller promptly sends an order confirmation to the email address provided by the Customer. Order confirmation does not yet mean that a Sales Contract has been concluded.

The Sales Contract is concluded at the moment the Seller accepts the order for processing, of which the Customer is informed by a separate email.

If fulfillment of the order proves impossible, the Seller will promptly inform the Customer and — if payment has already been made — refund the received funds promptly, no later than within the timeframe required by applicable law.

Product availability

Product availability information is displayed in real time in the Store. In exceptional cases, despite an order being placed, fulfillment may be impossible for reasons beyond the Seller's control, in particular due to simultaneous purchase of the last unit by multiple Customers.

In such a case, the Seller will inform the Customer that the order cannot be fulfilled and will refund all payments received.

Prices

All prices displayed in the Store are gross prices and include VAT where applicable under applicable law. Prices are displayed in the currency appropriate to the selected country or language version of the Store.

The total order value, including the price of the Products, delivery costs and any other charges, is presented to the Customer before placing the order.

The Seller may organize promotions and promotional campaigns under the terms set out in separate regulations or the terms of a given promotion. When displaying reduced prices, the Seller also shows the lowest price applicable during the 30-day period prior to the price reduction, in accordance with applicable law.

Payments

The Customer may use the payment methods made available in the Store for the selected delivery country. Current information on available payment methods, payment operators and currencies is available in the Payment Methods document.

For electronic payments, order processing begins upon the Seller's receipt of confirmation of successful payment from the payment operator.

Delivery

The Seller delivers to the countries indicated in the Store. Current information on available delivery countries, carriers, delivery costs, free delivery thresholds and estimated processing times is available in the Shipping Policy document.

The risk of accidental loss or damage to the Product passes to the Consumer upon taking possession of the Product. For Customers who are not Consumers, the risk passes in accordance with the applicable provisions of the Civil Code.

Withdrawal from contract

A Customer who is a Consumer or an Entrepreneur with Consumer Rights has the right to withdraw from a Sales Contract concluded at a distance under the rules set out in applicable law.

Complaints regarding non-conformity of the Product with the contract

The Seller is liable for the conformity of the Product with the Sales Contract in accordance with applicable law. If the Product does not conform to the Contract, a Customer who is a Consumer or an Entrepreneur with Consumer Rights may exercise the rights provided for in the Consumer Rights Act.

A complaint may be submitted:

  • via the contact form,
  • by email,
  • in writing to the Seller's registered office address,
  • using the complaint form available on the Store's website.

Use of the complaint form is voluntary and serves only as a convenience. The Seller processes complaints in accordance with applicable law.

Manufacturer's warranty

In addition to the rights arising from the Seller's liability for conformity of the Product with the Contract, selected Products may be covered by a voluntary manufacturer's warranty. The warranty is granted by COOLING sp. z o.o. as the manufacturer of ENDORFY brand products.

The terms, scope and procedure for exercising the warranty are set out in the Manufacturer's Warranty Terms. Use of the warranty is voluntary and does not limit or exclude the Customer's rights under applicable law.

Newsletter

The Customer may voluntarily subscribe to the Newsletter to receive information about new products, promotions and other ENDORFY content. The rules of the Newsletter service are set out in the Newsletter Service Regulations.

Reviews and opinions

Customers may publish reviews and opinions about Products in accordance with the rules set out in the Review Policy. The Seller takes steps to ensure the reliability of published reviews in accordance with applicable law.

Personal data

The rules for processing personal data and using cookies are set out in the Privacy Policy, which forms an integral part of the Store's documentation.

Intellectual property

All rights to the Store and its content, in particular the ENDORFY name, trademarks, logos, graphics, photos, product descriptions, video materials, graphic designs and interface elements, belong to the Seller or entities cooperating with the Seller and are protected under applicable law. Use of materials available in the Store beyond fair use requires prior consent from the rights holder.

Out-of-court dispute resolution

The Consumer may use out-of-court methods of handling complaints and pursuing claims in accordance with applicable law. Information on available forms of out-of-court dispute resolution can be obtained in particular:

  • from the competent municipal or district consumer ombudsman,
  • from the regional inspector of the Trade Inspection,
  • on the websites of the Office of Competition and Consumer Protection.

Use of out-of-court dispute resolution methods is voluntary and requires the consent of both parties.

Changes to the Terms

The Seller may amend these Terms only for important reasons, in particular in the event of changes in law, changes in the scope or manner of providing services, introduction of new Store features, or organizational or technical changes affecting the content of the Terms.

Changes do not affect the acquired rights of Customers arising from Sales Contracts concluded before the new version of the Terms came into force. The new version of the Terms is published on the Store's website together with information on the date of its entry into force.

For continuously provided services, in particular the Customer Account and Newsletter, Customers will be informed of changes to the Terms in accordance with applicable law.

Final provisions

Polish law applies to Sales Contracts concluded through the Store, with the proviso that the choice of Polish law does not deprive the Consumer of the protection granted by provisions that cannot be excluded by agreement under the law of the country of the Consumer's habitual residence.

If any provision of the Terms proves invalid or ineffective, this does not affect the validity of the remaining provisions.

These Terms are effective from the date indicated at the beginning and are available free of charge on the Store's website in a form allowing them to be downloaded, saved and printed.
