Newsletter Service Regulations

Effective from: 1 July 2026

§ 1. General Provisions

  1. These regulations (hereinafter: "Newsletter Regulations") define the rules, terms and method of providing the free electronic service named Newsletter (hereinafter: "Newsletter Service") through the online store operating at www.endorfy.com (hereinafter: "Store").
  2. The provider of the Newsletter Service is COOLING B2C spółka z ograniczoną odpowiedzialnością with its registered office in Sokołów (05-806), ul. Sokołowska 24, NIP: 5342704020, REGON: 543298878, entered into the register of entrepreneurs of the National Court Register under KRS number 0001206753 (hereinafter: "Service Provider").
  3. The Newsletter Service is addressed to natural persons, legal persons, and organizational units without legal personality (hereinafter: "Subscriber").
  4. Acceptance of the Newsletter Regulations is voluntary but necessary to use the Newsletter Service.
  5. For matters related to the Newsletter Service, you can contact the Service Provider via:

§ 2. Subject of the Newsletter Service

  1. The Newsletter Service consists of the Service Provider periodically sending messages to the email address provided by the Subscriber, containing information about:
    1. product news, launches, and pre-sales;
    2. current promotions, sales, and discount codes;
    3. events, competitions, and special campaigns organized by the Endorfy brand;
    4. guides, articles, and other marketing content related to the Store's offer.
  2. In accordance with best market practices and to deliver content as tailored as possible to the Subscriber's interests, Newsletter messages may be personalized based on the Subscriber's activity in the Store (e.g., browsing history, purchase history, or abandoned cart information), using marketing automation tools such as ExpertSender. Profiling is used solely to tailor marketing content and does not constitute automated decision-making that produces legal effects or similarly significantly affects the Subscriber.   3. The frequency of sending messages within the Newsletter Service is not strictly defined and depends on the Service Provider's current marketing campaigns.
  4. The Newsletter Service is provided free of charge for an indefinite period.

§ 3. Conditions for concluding the agreement and technical requirements

  1. To use the Newsletter Service, the following technical requirements must be met:
    1. possession of a multimedia device with Internet access;
    2. possession of an active and properly configured email account;
    3. use of a standard web browser.
  2. Concluding an agreement for the provision of the Newsletter Service requires fulfilling the following steps:
    1. the Subscriber providing at least an email address in the appropriate form on the Store's website (or checking the appropriate box (so-called checkbox) during the process of creating an Account in the Store or placing an Order);
    2. reading and accepting these Newsletter Regulations and the Privacy Policy;
    3. clicking the subscribe confirmation button;
    4. clicking the verification (activation) link sent to the email address provided by the Subscriber.
  3. Upon clicking the activation link referred to in paragraph 2 letter d), an agreement for the provision of the Newsletter Service is concluded between the Service Provider and the Subscriber.
  4. It is forbidden for the User to provide email addresses belonging to third parties without their express consent.
  5. The conclusion of the Newsletter Service agreement is independent of granting any consents required by law for sending commercial information or using end telecommunications devices, where such consents are required. Detailed information on the legal bases for personal data processing and marketing consents is available in the Privacy Policy.

§ 4. Rights and obligations of the parties

  1. The Subscriber is obliged to use the Newsletter Service in a manner consistent with applicable law, good customs, and the provisions of the Newsletter Regulations, including in particular refraining from delivering unlawful content.
  2. The Service Provider undertakes to provide the Newsletter Service without interruption, however, reserving the right to temporarily suspend shipments due to technical reasons (e.g., system maintenance).
  3. The Service Provider is not liable for non-delivery of messages resulting from failures on the part of email service providers, anti-spam filters applied by the recipient, or other circumstances beyond the Service Provider's control.

§ 5. Resignation from the Newsletter Service (termination of the agreement)

  1. The Subscriber may at any time, without giving a reason and without incurring any costs, resign from the Newsletter Service (terminate the agreement).
  2. Resignation from the Newsletter Service is possible by:
    1. clicking the deactivation link (so-called "Unsubscribe") located in the footer of every email message sent as part of the Newsletter Service;
    2. unchecking the appropriate option in the Customer Account panel (for registered Store Subscribers);
    3. sending a statement of resignation to the Service Provider's email address indicated in § 1 para. 5 of the Newsletter Regulations.
  3. Termination of the agreement for the provision of the Newsletter Service results in the cessation of sending marketing messages to the provided email address. The removal of the email address from the mailing database occurs immediately, however, due to technical processes, it may take up to 48 working hours (during this time, the Subscriber may still receive a previously planned message).

§ 6. Statutory right of withdrawal from the agreement

  1. Regardless of the right to resign described in § 5, a Subscriber who is a consumer or an entrepreneur with consumer rights has the right to withdraw from the agreement for the provision of the Newsletter Service within 14 days from its conclusion (i.e., from clicking the activation link), without giving a reason.
  2. To exercise the right of withdrawal from the agreement, it is necessary to inform the Service Provider of your decision by means of an unequivocal statement sent, for example, by email.
  3. To meet the deadline, it is sufficient to send the statement before its expiry.
  4. The effect of withdrawal from the agreement is the immediate cessation of the Newsletter Service by the Service Provider.

§ 7. Complaint procedure

  1. The Subscriber has the right to file complaints regarding the performance of the Newsletter Service.
  2. Complaints should be submitted electronically to the Service Provider's email address or in writing to the Service Provider's registered office address.
  3. It is recommended that the complaint report include a description of the irregularities (e.g., not receiving messages, problems with unsubscribing), the email address assigned to the subscription, and the User's expectations.
  4. The Service Provider processes complaints promptly, no later than within 14 days from the date of their receipt, informing the Subscriber about the manner of their resolution to the email address provided by the Subscriber.

§ 8. Changes to the Newsletter Regulations and final provisions

  1. The Service Provider reserves the right to amend these Newsletter Regulations for important legal, technological, or business reasons (e.g., change of tools for sending the Newsletter, expansion of service functionalities). The amendments introduced will not infringe upon the acquired rights of Subscribers arising from agreements concluded before the date the amended Newsletter Regulations come into force.
  2. The Service Provider will inform Subscribers about all changes to the Newsletter Regulations by sending information to their email addresses at least 14 days in advance.
  3. If the Subscriber does not accept the new content of the Newsletter Regulations, they have the right to terminate the agreement (resign from the Newsletter Service) in the manner described in § 5. Failure to terminate the agreement before the changes come into force is considered an acceptance thereof.
  4. In matters not regulated by these Newsletter Regulations, the provisions of the endorfy.com online store regulations shall apply.
  5. The choice of Polish law does not deprive the Consumer of the protection granted to them based on provisions that cannot be excluded by agreement under the law of the country where the Consumer has their habitual residence.
