ENDORFY Product Warranty Terms

In the event of nonconformity of the sold item with the contract, the buyer is entitled by law to legal remedies from the seller at the seller's expense (statutory warranty for defects in the sold item). The granting of this warranty does not affect these legal remedies and constitutes only an additional consumer right.

The warranty is granted by Cooling sp. z o.o., owner of the ENDORFY brand, address: ul. Sokołowska 24, 05-806 Sokołów ("Warrantor").

Warranty Terms

  1. This warranty is granted to consumers and to entrepreneurs with consumer rights.
  2. The warranty is valid on the territory of the Republic of Poland for new Endorfy brand products purchased on the territory of the Republic of Poland.
  3. Warranty rights are exercised on the basis of proof of purchase (fiscal receipt or VAT invoice) enabling identification of the product, the date of purchase, the seller's details and optionally the product model, serial number or other marking identifying the product.
  4. The Warrantor guarantees that Endorfy brand products will be free from manufacturing and material defects.
  5. The warranty is valid for the period indicated in the product specification or on its packaging. The warranty period is calculated from the date of purchase shown on the proof of purchase.
  6. The person entitled under the warranty may request repair or replacement of the product. The Warrantor may replace the product when the claimant requests repair, or may repair it when the claimant requests replacement, if the method of warranty fulfillment chosen by the claimant is impossible or would entail excessive costs.
  7. If repair or replacement is impossible or would involve excessive costs, the Warrantor may decide to fulfill the warranty by refunding the price paid for the product through the seller.
  8. The warranty covers only physical defects and the product's firmware. The warranty does not cover the operation of additional software that extends the product's functionality or third-party software.
  9. The Warrantor reserves the right to update the claimed product to the currently sold version, e.g., by updating firmware or replacing components with newer revisions, even if this is not directly related to the defect.
  10. Replacement with a new, defect-free product may be carried out by exchanging it for the same model or a model similar in functionality and quality and not worse in parameters (which may differ slightly in design and technical specifications), if repair would be impossible or would entail excessive costs.

Warranty Exclusions

  1. The Warrantor's liability under the warranty covers only defects resulting from causes inherent in the sold item.
  2. In the case of a grossly unjustified complaint resulting from an abuse of rights by the claimant, the Warrantor may require the claimant to repair the damage suffered in connection with the abuse. In particular, the Warrantor may demand reimbursement of delivery and handling costs related to the complaint.
  3. Warranty rights expire with respect to a product in which the following are found:
    1. use of the product contrary to its intended purpose and contrary to the user manual;
    2. exposure of the product to external factors, e.g., heat, moisture, large temperature fluctuations, contaminants (including tobacco smoke, e-cigarette vapor, food, liquids), chemicals, overloading, lightning strike, short circuit, flooding, etc.;
    3. force majeure events, e.g.: storm, flood, fire, inundation, infestation;
    4. mechanical damage resulting from use or accidents and random events (e.g., scratches, cracks, chips). Any cosmetic defects such as scratches, cracks, paint defects may be recognized only if the product is new and shows no signs of installation and/or use;
    5. use of improper software not supplied with the product when resulting from user intervention (e.g., installing incorrect drivers, using software without a license);
    6. unauthorized interference, modification, breach of warranty seals, tampering with labels (stickers) bearing the serial number (if present);
    7. incorrect installation or assembly or improper maintenance and operation (e.g., powering the device with incorrect voltage).

Warranty Claim Procedure

  1. All complaints are handled exclusively through the online IT system at endorfy.com/RMA.
  2. When filing a complaint, the person entitled under the warranty chooses the preferred method of warranty fulfillment (repair or replacement) and enters the following information into the system: product model, product serial number, date of purchase, copy of the sales document, detailed description of the defect, return address.
  3. The claimant should report the product defect to the Warrantor within 14 days from the date of its detection, under pain of possible refusal by the Warrantor to perform the obligations under the granted warranty.
  4. After verifying the correctness of the complaint, the warranty service may request additional explanations or documentation (in particular photos of the product), and then will respond and propose a solution within 14 days by means of remote assistance and/or collecting the product at the Warrantor's expense.
  5. The Warrantor will carry out the repair or replacement within a reasonable time. The Warrantor will make every effort to remedy the defect no later than within 21 days from the date the product is delivered to the place of warranty service or made available to the Warrantor. In special cases (including the need to source spare parts or a product from abroad), the repair or replacement period may be extended, but by no more than an additional 14 days.
  6. The place of warranty fulfillment is the Warrantor's service headquarters at: COOLING sp. z o.o., ul. Sokołowska 24, 05-806 Sokołów.
  7. Shipments sent to the Warrantor must be clearly marked with the assigned complaint number in a visible place. Shipments without the complaint number visible are not accepted.
  8. Products returned to the warranty service should be complete. Sending an incomplete product may extend or prevent the warranty fulfillment. The product should be protected against damage that may occur during transport. Refusal to make the product available to the Warrantor for repair or replacement may result in the complaint being considered unfounded.
