ENDORFY Product Warranty Terms
General Information
In the event of a lack of conformity of the goods with the contract, consumers are entitled by law to remedies against the seller free of charge. These statutory rights are not affected or limited by this voluntary manufacturer's warranty.
This warranty is a voluntary commercial warranty granted by Cooling sp. z o.o., owner of the ENDORFY brand, with its registered address at ul. Sokołowska 24, 05-806 Sokołów, Poland ("Warrantor"). It constitutes an additional contractual right granted to the consumer independently of the consumer's statutory rights against the seller.
Warranty Terms
1. This voluntary manufacturer's warranty is granted to consumers who purchase new ENDORFY brand products within the European Union.
2. The warranty applies throughout the European Union to new ENDORFY brand products purchased within the European Union, subject to the terms and conditions set out herein.
3. Warranty rights are exercised on the basis of proof of purchase, such as a receipt, VAT invoice or other document confirming the purchase and enabling identification of the product, the date of purchase and the seller. Where applicable, the product model, serial number or other product identifier may also be required.
4. The Warrantor guarantees that ENDORFY brand products covered by this warranty will be free from manufacturing and material defects under normal use during the applicable warranty period.
5. The warranty is valid for the period specified for the relevant product in its product specification, documentation or on its packaging. The warranty period starts on the date of purchase indicated on the proof of purchase.
6. The person entitled under the warranty may request repair or replacement of the defective product. The Warrantor may replace the product where repair is requested, or repair the product where replacement is requested, if the remedy selected by the claimant is impossible or would entail disproportionate costs for the Warrantor.
7. If both repair and replacement are impossible or would entail disproportionate costs, the Warrantor may fulfil its obligations under this warranty by refunding the purchase price of the product. Where appropriate, the refund may be processed through the seller from whom the product was purchased.
8. The warranty covers manufacturing and material defects of the product, including defects relating to the product's firmware where the firmware forms part of the product. The warranty does not cover third-party software or additional software that is not necessary for the basic operation of the product.
9. Where necessary to perform a repair or replacement, the Warrantor may update the product to the version currently supported or sold, including by updating its firmware or replacing components with newer revisions, provided that this does not materially reduce the functionality or performance of the product.
10. Where replacement of the product is necessary, the Warrantor may replace it with the same model or, if that model is no longer reasonably available, with another product of comparable or better functionality and technical parameters. The replacement product may differ in design or individual technical specifications from the original product.
Warranty Exclusions
1. The Warrantor's liability under this voluntary manufacturer's warranty covers defects resulting from causes inherent in the product, in particular manufacturing and material defects.
2. The warranty does not cover defects or damage resulting from:
a. use of the product contrary to its intended purpose, technical specifications or user instructions;
b. exposure of the product to inappropriate external conditions, including excessive heat, moisture, significant temperature fluctuations, contamination, liquids, chemicals, tobacco smoke or e-cigarette vapour, electrical overload, lightning strike, short circuit or flooding;
c. force majeure events, including fire, flood, storm or other comparable external events;
d. mechanical damage resulting from improper use, accidents or other external events, including scratches, cracks, chips or other physical damage not resulting from a manufacturing or material defect;
e. the use or installation of improper software, firmware or drivers where the defect or damage results from such use or installation;
f. unauthorised repair, modification or interference with the product, including tampering with warranty seals or labels bearing a serial number or other product identifier, where such interference is related to the reported defect;
g. incorrect installation, assembly, maintenance or operation of the product, including supplying the product with incorrect voltage or otherwise using it contrary to its technical requirements.
3. Cosmetic defects, including scratches, cracks, paint defects or other visual imperfections, may be covered by the warranty where they were present when the new product was delivered and are not the result of subsequent installation, use or handling.
4. Exclusion of a particular defect or damage from this voluntary manufacturer's warranty does not affect any statutory rights the consumer may have against the seller under applicable law.
Warranty Claim Procedure
1. Warranty claims under this voluntary manufacturer's warranty must be submitted through the online warranty claim system available at: https://endorfy.com/RMA
2. When submitting a warranty claim, the claimant should provide the information necessary to identify and assess the claim, including:
a. product model;
b. product serial number, where applicable;
c. date of purchase;
d. copy of the proof of purchase;
e. detailed description of the reported defect;
f. claimant's contact details and return address.
3. The claimant should report the defect without undue delay after its detection. A delay in reporting the defect does not in itself result in the loss of warranty rights, unless and to the extent that the delay has caused or materially increased the damage or prevents reliable assessment of the reported defect.
4. After receiving and verifying the warranty claim, the Warrantor may request additional information or documentation necessary to assess the claim, in particular photographs or recordings showing the reported defect.
5. Where the claim can be assessed or resolved remotely, the Warrantor may provide remote technical assistance without requiring the product to be sent to the warranty service centre.
6. Where physical inspection, repair or replacement of the product is required, the claimant must deliver the product to the Warrantor's warranty service centre at:
COOLING sp. z o.o.
ul. Sokołowska 24
05-806 Sokołów
Poland
The claimant is responsible for arranging and bearing the cost of delivering the product to the warranty service centre in Sokołów, Poland.
The Warrantor bears the cost of returning the repaired or replacement product to the claimant within the European Union.
7. The obligation to arrange and bear the cost of delivering the product to the Warrantor applies exclusively to claims made under this voluntary manufacturer's warranty. It does not apply to the exercise of the consumer's statutory rights against the seller in the event of a lack of conformity of the goods with the contract. The consumer's statutory remedies against the seller remain unaffected by this warranty and may be exercised free of charge in accordance with applicable law.
8. The Warrantor will carry out the repair or replacement within a reasonable period of time. The Warrantor will make every reasonable effort to complete the repair or replacement no later than within 21 days from the date on which the product is delivered to the warranty service centre.
In exceptional cases, including where spare parts or a replacement product must be sourced from abroad, this period may be extended by up to an additional 14 days. The claimant will be informed if such an extension is necessary.
9. Products sent to the warranty service centre must be clearly marked with the warranty claim number assigned by the Warrantor. The claimant should follow the shipping instructions provided after registration of the warranty claim.
10. The product should be delivered complete to the extent necessary to assess and remedy the reported defect. The Warrantor may request accessories or other components where they are necessary to reproduce, diagnose or remedy the reported defect.
11. The claimant is responsible for appropriately packaging the product to protect it against damage during transport to the warranty service centre.
12. If the claimant does not make the product available to the Warrantor where physical inspection of the product is reasonably necessary to assess or fulfil the warranty claim, the Warrantor may be unable to process the claim until the product is made available.
Statutory Consumer Rights
This voluntary manufacturer's warranty is additional to the consumer's statutory rights and does not replace, restrict or otherwise affect them.
In the event of a lack of conformity of the goods with the contract, the consumer is entitled by law to remedies against the seller free of charge in accordance with applicable law.
Claims based on these statutory rights should be addressed to the seller from whom the product was purchased. The conditions applicable to such statutory claims, including any obligations relating to transport or return of the product, are governed by applicable law and are independent of the conditions of this voluntary manufacturer's warranty.
