Section 3 — Orders

When you place an order you are making an offer to purchase. ENDORFY reserves the right to accept or refuse your order for any reason at our sole discretion. Your order will not be accepted until the ENDORFY store confirms acceptance. We must receive and process your payment before accepting an order. Please review your order carefully before placing it, because the ENDORFY store may not honor cancellation requests after an order is accepted. In the event of rejection, modification or cancellation of an order, we will notify you using the email address, billing address and/or phone number provided at the time the order was placed.

Your purchases are subject to return or exchange only in accordance with our Return Policy.

You represent and warrant that you are purchasing for personal use only, not for commercial resale or export.

Section 4 — Prices & billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service is the price in effect at the time the order is placed. It will be stated in the order confirmation email. Unless otherwise expressly stated, prices shown do not include taxes, shipping, handling, duties or import fees.

Prices listed in our online stores may differ from those offered in physical stores or on the internet or other stores operated by third parties. From time to time we may offer promotions for the Services that may affect pricing and which may be subject to terms different from these Terms. In case of a conflict between the promotion terms and these Terms, the promotion terms prevail.

You agree to promptly update your account information and other information, including your email address, credit card numbers and expiration dates, so we can process your transactions and contact you if necessary.

You represent and warrant that (i) the credit card information is true, correct and complete; (ii) you have the necessary authorization to use the credit card for purchases; (iii) charges will be honored by your card issuer; (iv) you will pay all charges incurred in accordance with the prices offered, including shipping and handling fees, and any applicable taxes.

Section 5 — Shipping & delivery

We are not responsible for shipping and delivery delays. All delivery timeframes are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs processing or events beyond our control. Once products are handed to the carrier, title and risk of loss pass to you.

Section 6 — Intellectual property

Our Services, including but not limited to any trademarks, branding, text, displays, images, graphics, product reviews, video and audio materials, and their design, selection and arrangement, are the property of the ENDORFY store, its affiliates or licensors and are protected by patent, copyright and other intellectual property laws.

The ENDORFY store is powered by Shopify. This enables us to offer you our Services. However, all sales and purchases made in our Store are conducted directly by the ENDORFY store. By using the Services, you acknowledge that Shopify is not responsible for any aspect of the sale between you and the ENDORFY store, including any injuries, damages or losses resulting from the purchase of products and services. You confirm that your Feedback does not violate any third-party rights, including copyrights, trademarks, privacy rights and other personal or property rights. You also confirm that your Feedback does not contain offensive or otherwise unlawful, harmful or obscene content, nor does it contain viruses or other malicious code that could in any way affect the operation of the Services or the related website. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE ENDORFY STORE, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS NOR THE PLATFORM PROVIDER SHOPIFY AND ITS AFFILIATES BE LIABLE FOR ANY LOSS, CLAIM OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA, REPLACEMENT COSTS OR ANY OTHER SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS RESULTING FROM THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN CONTENT, OR FOR ANY LOSSES OR DAMAGES INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCTS) POSTED, LINKED, TRANSMITTED OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend and hold harmless the ENDORFY store, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities or claims, including reasonable attorneys' fees, brought by any third party arising out of (1) your breach of these Terms of Service or documents referenced herein, (2) your violation of any law or third party rights, or (3) your access to or use of the Services.

We will notify you of any indemnifiable claims, provided that failure to give timely notice shall not relieve you of your obligations unless you can show actual prejudice. We may assume control of the defense and settlement of such claim at your expense, including selecting counsel, but we will not settle any claims involving non-monetary relief without your consent (which will not be unreasonably withheld). You must cooperate with us in the defense of such claims, including by providing relevant documents.

If any provision of these Terms of Service is held to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be deemed severed from these Terms of Service, which will remain in full force and effect.

Our failure to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of these Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
