Newsletter Terms of Service
Newsletter Service Terms and Conditions
Effective from: 1 July 2026
§ 1. General provisions
- These terms and conditions (hereinafter: the “Newsletter Terms”) set out the rules, conditions and manner of providing a free electronic service called Newsletter (hereinafter: the “Newsletter Service”) through the online store operating at www.endorfy.com (hereinafter: the “Store”).
- The Newsletter Service is provided by COOLING B2C spółka z ograniczoną odpowiedzialnością, with its registered office in Sokołów (05-806), ul. Sokołowska 24, Poland, NIP (Tax ID): 5342704020, REGON: 543298878, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0001206753 (hereinafter: the “Service Provider”).
- The Newsletter Service is intended for natural persons, legal persons and organisational units without legal personality (hereinafter: the “Subscriber”).
- Acceptance of the Newsletter Terms is voluntary but necessary in order to use the Newsletter Service.
- In matters relating to the Newsletter Service, the Service Provider may be contacted via:
- e-mail: sklep@endorfy.com;
- the contact form available on the Store website.
§ 2. Subject of the Newsletter Service
- The Newsletter Service consists of the Service Provider periodically sending messages to the e-mail address provided by the Subscriber, containing information about:
- new products, product launches and pre-orders;
- current promotions, sales and discount codes;
- events, contests and special campaigns organised by the Endorfy brand;
- guides, articles and other marketing content related to the Store’s offer.
- In line with market best practice and in order to deliver content that best matches the Subscriber’s interests, messages sent as part of the Newsletter Service may be personalised based on information about the Subscriber’s activity in the Store (e.g. browsing history, purchase history or abandoned cart information), using marketing automation tools such as ExpertSender. Profiling is used solely to tailor marketing content and does not constitute automated decision-making that produces legal effects concerning the Subscriber or similarly significantly affects them. Detailed information on the processing of personal data can be found in the Privacy Policy.
- The frequency of messages sent as part of the Newsletter Service is not fixed and depends on the Service Provider’s current marketing activities.
- The Newsletter Service is provided free of charge for an indefinite period.
§ 3. Conditions for concluding the agreement and technical requirements
- To use the Newsletter Service, the following technical requirements must be met:
- a multimedia device with Internet access;
- an active and properly configured e-mail account;
- a standard web browser.
- Concluding the agreement for the provision of the Newsletter Service requires the following steps:
- the Subscriber entering at least their e-mail address in the relevant form on the Store website (or ticking the relevant box (checkbox) when creating an Account in the Store or placing an Order);
- reading and accepting these Newsletter Terms and the Privacy Policy;
- clicking the button confirming the subscription;
- clicking the verification (activation) link sent to the e-mail address provided by the Subscriber.
- Upon clicking the activation link referred to in section 2(d), the agreement for the provision of the Newsletter Service is concluded between the Service Provider and the Subscriber.
- The Subscriber may not provide e-mail addresses belonging to third parties without their express consent.
- The agreement for the provision of the Newsletter Service is concluded independently of granting the consents required by law to receive commercial information or to the use of telecommunications terminal equipment, where such consents are required. Detailed information on the legal bases for processing personal data and on marketing consents can be found in the Privacy Policy.
§ 4. Newsletter sign-up discount
- A Subscriber who concludes the agreement for the provision of the Newsletter Service in the manner described in § 3 receives a one-time discount of 15% (hereinafter: the “Newsletter Discount”).
- The Newsletter Discount is calculated on the value of the entire Order, subject to section 4. It does not apply to delivery costs.
- After concluding the agreement for the provision of the Newsletter Service, the Subscriber receives an e-mail at the address provided containing an “Apply discount” button. Clicking this button takes the Subscriber to the Store, and the Newsletter Discount is automatically applied in the cart. The discount must be activated in this way before placing the Order. If the Subscriber places an Order without first clicking the button, the discount will not be applied to that Order.
- The Newsletter Discount applies only to products that are not reduced in price, i.e. products that, at the time the Order is placed, are not subject to a reduced price, promotion or sale. The discount is not applied to reduced-price products in the same Order.
- The Newsletter Discount cannot be combined with other discounts, discount codes or Store promotions. The exception is free delivery, on the terms set out in the Store terms and conditions.
- The Newsletter Discount may be used once per Subscriber (one e-mail address). It cannot be exchanged for cash or transferred to another person.
- Unsubscribing from the Newsletter Service or withdrawing from the agreement after using the Newsletter Discount does not give rise to an obligation to refund its value.
§ 5. Rights and obligations of the parties
- The Subscriber must use the Newsletter Service in accordance with applicable law, good practice and the provisions of the Newsletter Terms, and in particular must refrain from providing unlawful content.
- The Service Provider undertakes to provide the Newsletter Service continuously, but reserves the right to temporarily suspend sending for technical reasons (e.g. system maintenance).
- The Service Provider is not liable for failure to deliver messages resulting from failures on the part of e-mail service providers, spam filters used by the recipient or other circumstances beyond the Service Provider’s control.
§ 6. Unsubscribing from the Newsletter Service (termination of the agreement)
- The Subscriber may unsubscribe from the Newsletter Service (terminate the agreement) at any time, without giving a reason and without incurring any costs.
- The Subscriber can unsubscribe from the Newsletter Service by:
- clicking the unsubscribe link (“Unsubscribe”) in the footer of every e-mail sent as part of the Newsletter Service;
- unticking the relevant option in the Customer Account panel (for registered Store Subscribers);
- sending an unsubscribe request to the Service Provider’s e-mail address indicated in § 1 section 5(a) of the Newsletter Terms.
- Termination of the agreement for the provision of the Newsletter Service results in marketing messages no longer being sent to the e-mail address provided. The e-mail address is removed from the mailing list without undue delay; however, due to technical processes, this may take up to 48 hours (during this time the Subscriber may still receive a previously scheduled message).
§ 7. Statutory right of withdrawal
- Regardless of the right to unsubscribe described in § 6, a Subscriber who is a consumer, or a sole trader entitled to consumer rights, may withdraw from the agreement for the provision of the Newsletter Service within 14 days of its conclusion (i.e. from clicking the activation link), without giving any reason.
- To exercise the right of withdrawal, the Subscriber must inform the Service Provider of their decision by an unequivocal statement, sent e.g. by e-mail.
- To meet the deadline, it is sufficient to send the statement before the deadline expires.
- Withdrawal from the agreement results in the Service Provider immediately ceasing to provide the Newsletter Service.
§ 8. Complaints procedure
- The Subscriber has the right to submit complaints regarding the provision of the Newsletter Service.
- Complaints may be submitted electronically to the Service Provider’s e-mail address or in writing to the Service Provider’s registered office address.
- It is recommended that the complaint include a description of the problem (e.g. not receiving messages, problems with unsubscribing), the e-mail address associated with the subscription, and the Subscriber’s expectations.
- The Service Provider handles complaints without undue delay, no later than within 14 days of receipt, and informs the Subscriber of the outcome at the e-mail address provided by the Subscriber.
§ 9. Amendments to the Newsletter Terms and final provisions
- The Service Provider reserves the right to amend these Newsletter Terms for important legal, technological or business reasons (e.g. a change of the tools used to send the Newsletter, extension of the service’s functionality). Amendments will not infringe the acquired rights of Subscribers arising from agreements concluded before the effective date of the amendments to the Newsletter Terms.
- The Service Provider will inform Subscribers of any amendments to the Newsletter Terms by sending information to their e-mail address at least 14 days in advance.
- If the Subscriber does not accept the new version of the Newsletter Terms, they may terminate the agreement (unsubscribe from the Newsletter Service) in the manner described in § 6. Failure to terminate the agreement before the amendments take effect is deemed acceptance of the amendments.
- In matters not governed by these Newsletter Terms, the provisions of the terms and conditions of the www.endorfy.com online store apply.
- The choice of Polish law does not deprive the Consumer of the protection afforded to them by provisions that cannot be derogated from by agreement under the law of the country in which the Consumer has their habitual residence.
